Consumer Rights in Good News : Passenger Compensated by Airlines

Justice prevailed for a Chandigarh resident Rajeev Tandon when he filed a case of mental agony and physical harassment against SpiceJet. Last year during winter vacations, Mr Tandon left for Port Blair with his family for a vacation. His son Arman who suffers from cerebral palsy is required to be in a wheelchair at all times.

The problem sprang up when Mr Tandon booked four SpiceJet tickets for his family members in December after paying Rs. 73,028 through an agent named Sandesh Kanwar Corporate Flyers Pvt. Ltd. Mr Tandon opted for meals along with his tickets. However, the airline not only refused to serve meals to his family on the flight, but also out of sheer negligence they unloaded his son’s wheelchair in Kolkata instead of Portblair.

The flight scheduled to take off at 7:55 a.m., got delayed and flew at around 10 a.m. The scheduled minute halt at Kolkata was also stalled. The complainant’s family were not able to take breakfast as they were supposed to have it in the flight itself. However, the crew members refused to serve the family members any meal even though they were willing to pay extra for it. Despite this, they did not permit the family members to leave the flight to get their hungry son something to eat. As if enough miseries were not knocking upon the door of Mr Tandon’s family, their son’s wheelchair was missing from their luggage once they reached Portblair. Upon questioning, the staff said that they had mistakenly unloaded the wheelchair at Kolkata Airport. Mr Tandon had to carry his son whole day before they got the wheelchair back.

The good news in all of it was that Mr Tandon filed a case of mental agony and physical harassment on SpiceJet and went on to win it. Rajeev filed a case in Chandigarh District Consumer Forum and it directed SpiceJet to pay a compensation of Rs. 30,000 plus 5,500 as litigation expenses. The positive thing about this agonizing situation was that  justice prevailed and the victim finally got compensated for all the misery that he had to suffer when he was not at any fault. It is an example for all those who believe that justice is denied when one is pitted against influential people. Mr Tandon’s case proved that people can still place their faith in the judicial system of our country.
